Notice of Public Auction

To Whom it May Concern:

 

Please be advised that pursuant to the laws of the State of Michigan and the City Charter for the City of Negaunee, the City of Negaunee hereby gives notice of its intent to sell at a public auction on Thursday, April 25, 2019, at 10:00 A.M. in the City of Negaunee City Hall, Parcel #: 52-53-705-004-00, commonly known as former Wastewater Treatment Plant property (the “Property”), and more particularly described as:

Part of the South Half of the Northeast Quarter (S½ NE¼), Section Five (5), Township Forty-seven North, Range Twenty-six West (T47N, R46W), described as follows:  Commencing at the North ¼ corner of said Section 5; thence South 1755.02 feet and East 1287.24 feet to a point on the Southerly right of way line of Old County Road 480 (150 foot right of way as described in Liber 118 of Deeds, Pages 213-214, Marquette County Records), said point being the POINT OF BEGINNING; thence South 461.04 feet; thence East 900 feet; thence North 763.45 feet to the Southerly right of way of New County Road 480; thence Southwesterly along said right of way 914.10 feet to the POINT OF BEGINNING, EXCEPTING THEREFROM the right of way of New County Road 480.

The minimum opening bid for the Property shall be $30,000.00.  The Property will be sold to the highest bidder “AS IS” by Quit Claim Deed with no guarantees for any further construction and/or improvements to the Property, and subject to any existing easements and further subject to any future easements needed for roads or utilities.  The City of Negaunee reserves the right, for one (1) year from the date of the sale, to remove sandstone blocks originally from the Sundberg Building currently being stored on the Property and stacked on pallets.  The successful bidder shall be responsible for all costs, fees and expenses associated with the purchase.

The successful bidder at said auction will be required, at the conclusion of the auction, to make a down payment equal to 10% of the final sale price.  Final payment, plus a deed recording fee of $125.00, will be due no later than seven (7) days after the date of said auction (April 25, 2019). The successful bidder shall also be required to sign, under penalties of perjury, a statement that neither they nor any other person, who would gain equity in the property, have any tax delinquencies or are otherwise in default to the City of Negaunee.  Upon receipt of the full payment, the City Treasurer shall execute, deliver, and cause to be recorded on behalf of the City of Negaunee the quit claim deed necessary to transfer the title of the Property.

All Bidders must register at the City of Negaunee City Hall and be present prior to the commencement of said Auction.  Registration will begin at 9:00 a.m. and close promptly at 9:45 a.m.

A copy of the Negaunee City Council resolution approving this public auction and the proposed quit claim deed for the property are available for inspection at the City Treasurer’s office at the Negaunee City Hall.
